New Hire Check List
Congratulations on your newest employee - here are a few friendly reminders of what to do next:

1. Gather all your new hire paperwork and information:
- Name
- Address
- Social Security Number
- Date of Birth
- Signed W-4, DE-4 (for CA employees) and I-9
- Direct Deposit form(s) - if applicable

It is important to verify each employees information. With the submission of W-2's for 2018, the government began to crack down on mis-matched employee information. It is important for employers to have their employees information record exactly how it is on the individuals social security card
Reminder, when an employee completes their 2020 (or later) W-4 form, California does not recognize that same withholding rate. If they use the W-4 for California, your employee most likely will be under withheld in taxes.

From the California website: 

"When you hire an employee, you must have them complete and sign both withholding certificates: the federal Form W-4 and the state DE 4. The W-4 is used for federal income tax and the DE 4 is used for California Personal Income Tax (PIT)."

California Labor Law 
The California Department Of Industrial Relations requires all California businesses with employees to prominently post a number of labor law posters, covering topics such as the minimum wage, health & safety, and other important labor laws, in the workplace. 

Every California business must display state, federal & OSHA notices. You can purchase an all in one poster online, or you can print each of these and have then available to your employees. There are 16 Required California Posters and 6 Federal Posters.

Covid-19 Supplemental Sick Leave
Information about the COVID-19 supplemental sick time off - for companies with 26 or more employees.

2022 Covid Supplemental sick leave provides covered employees up to 80 hours of COVID-19 related paid leave. Up to 40 of those hours can be used for isolation and quarantine, receiving vaccines and caring for a child whose school or place of care is closed. The additional 40 hours are available only when an employee, or family member for whom the employee provides care, tests positive for COVID-19. 

California Sick Law
As an employer, there are several things you must do to comply with the Health Work space/Healthy Family Act of 2014.

  • Display the Paid Sick leave poster for each employee to have access to. Paid Sick time leave poster: EnglishSpanish, Vietnamese, Chinese.  For San Francisco, there is a special Paid sick leave San Francisco Poster.
  • Provide written notice to employees with sick leave rights (see above for link) 
  • Provide proper accrual of 1 hour earned for 30 hours worked, or 3 days instantly available at the begining of each year. 
  • Allow eligible employee to use paid sick time upon reasonable request.
  • Keep record showing how many hours have been earned and used for at least 3 years. 
  • Show how much sick time is available on the employees check stub or have a supplemental document issued with each pay check.
